SALES CONTRACT CONDITIONS 

Whereas 

Through the publication of our entire product range on the website, we offer the customer the opportunity to formulate a purchase proposal, which will take on contractual value only once the same has fully read and accepts the conditions indicated in the regulation, set out below. 

1. The contract will be considered concluded with acceptance of the proposal by Forni per Pizza Italiani. 

2. Forni per Pizza Italiani has the right not to accept the proposal without 

3. anything due to the customer. 

4. Forni per Pizza Italiani reserves the right to make changes to the products illustrated at any time and without notice, in an attempt to improve them; therefore photos and technical data sheets may not perfectly represent the characteristics of the illustrated product.

“Forni Pavesi Rimini di Pavesi Eros”, duly registered in the Rimini business register with VAT number 04235310408. 

The company Forni Pavesi Rimini di Pavesi Eros has its legal and operational headquarters in Via Francesco Sapori no. 30, in Rimini, VAT/Tax Code: 04235310408. 

Acceptance of general contractual terms 

The contract stipulated between Forni per Pizza Italiani and the customer is concluded with 

the acceptance of the order by Forni per Pizza Italiani. 

This acceptance is considered tacit; if this is not the case, Forni per Pizza Italiani is required to communicate this to the customer after verifying the order. 

At the time of the order, the customer declares to have read and fully accepted the general conditions of sale and payment. 

The customer is obliged to keep these general conditions of sale (in compliance with the provisions of Articles 50 and following of Legislative Decree 206/05) in hard copy or electronic format. 

Purchase procedure 

All products in the www.forniperpizzaitaliani.com 

electronic catalogue can be purchased by the customer, who can also receive personalised quotes, including sales prices, transport prices, payment methods, items in order, delivery address and corresponding VAT. 

The receipt of payment is confirmed by Forni per Pizza Italiani via e-mail sent to the e-mail address provided by the customer. 

This confirmation message will contain all the details of the order such as: the order number, order date, billing data and recipient of the goods, details and prices including VAT of the ordered goods. 

Forni per Pizza Italiani will proceed with the activation of the phases relating to the production/shipment of the goods only once payment has been received from the customer. 

Any changes to already confirmed orders cannot be guaranteed, which will eventually be authorised by Forni per Pizza Italiani on the basis of the progress of production. 

Delivery terms 

Delivery terms cannot be considered binding towards the conclusion of the contract stipulated with Forni per Pizza Italiani. 

Any advances or delays in the delivery terms indicated in the product sheet, which are not identifiable at the time of the order, but only during the preparation or production phases of the same, will be communicated as soon as Forni per Pizza Italiani itself becomes aware of it. 

The latter cannot be considered as a pretext for claims for damages or compensation by the customer. 

Warranties 

Our products are subject to the provisions of Legislative Decree 206/05. 

In case of purchase made by an end consumer (private) the warranty will be valid for 24 months. 

In all other cases the warranty is 12 months. 

Pursuant to Legislative Decree 206/05, the warranty applies to products with conformity defects, provided that the product itself has been used correctly in its intended use. In case of conformity defects, Forni per Pizza Italiani will send the spare parts necessary to restore the conformity of the product, at no cost to the customer. 

Any defects already found at the delivery of the material must be communicated to Forni per Pizza Italiani within 5 days of receipt of the same via e-mail to shop@fornipavesirimini.it, indicating the article code. 

In the event that Forni per Pizza Italiani is unable to restore or replace a product under warranty, the same may proceed to replace it with a product of similar or superior characteristics to the one with a verified defect, or alternatively, to return the amount paid taking into account the wear and tear of the product. 

In cases of replacement under warranty, Forni per Pizza Italiani will collect the defective material for the effective verification of the defects claimed by the customer. 

The goods under warranty must be returned by the customer in the original packaging properly sealed and complete in all its parts. 

Forni per Pizza Italiani will be able to take care of the transport and return of the goods, replacement/repaired under warranty. In any case, the transport costs will be borne by the customer. 

For the purposes of the validity of the warranty, the customer is required to keep the original packaging and all the documentation of the products purchased, until the end of the warranty period (12/24 months). 

Forni per Pizza Italiani does not guarantee damage caused by incorrect item use. 

Should any damage be observed upon unloading of the goods it is necessary to: 

Indicate reserves: the package can be accepted, but the customer must put the words “I accept with right to reserve” when signing the shipping bill. 

If you comply with the above procedures, it will be possible, once the package has been opened and the actual damage has been assessed, to be compensated for the damage suffered. 

You may reject obviously damaged goods if it is not possible to accept the package with reserve and this in the event that the damage is still visible without opening the package. 

The customer is required to report the damage within 5 days of delivery. 

Otherwise, Forni per Pizza Italiani will not be liable for any damage. 

Product not working 

At the time of purchase, each product enjoys the original manufacturer’s warranty of 12 months.

Jurisdiction 

The sales contracts are governed by the laws of the Italian Republic. 

Any dispute relating to the existing contract will be exclusively submitted to the Court of Rimini. 

The Customer is obliged to keep these “general conditions of sale and purchase” in hard copy or electronic format with validity in progress at the time the remote contract is signed (customer order date). 

AFTER SALES SERVICE 

Package damaged at delivery 

If the package is damaged during transport and has dents or external anomalies, just accept the package by signing the shipping bill with reserve. Acceptance with reserve will allow us to activate the insurance, at no additional cost, to provide you with a quick solution to the problem. 

N.B. If you notice even slight anomalies, always sign with reserve: if you do not sign with reserve, it will not be possible to activate the transport insurance. 

Payment method 

The prices shown in the product sheet of the items that can be ordered on-line or quoted and the relative transport costs are always excluding VAT. 

Upon purchase, the customer can select one of the following payment methods: 

  • Credit card 
  • PayPal 
  • C.O.D. 
  • (40% at order – 60% at delivery) 
  • Advance bank transfer 

Right of withdrawal 

The customer can exercise the right of withdrawalwithin 14 business days from the date of receipt of the goods by informing Forni per Pizza Italiani of his/her decision to withdraw from the contract through an explicit declaration (enter name, geographical address and, if available, the number telephone number and e-mail address) declaring that you wish to make use of the right of withdrawal and indicating the order number, invoice number, code and quantity of the items, if the withdrawal is partial (only in case of purchase of several items) or total and the bank details to obtain the refund transfer (Iban code of the invoice holder). 

The goods must be returned intact in the original packaging, properly sealed, complete in all its parts (including packaging, internal protections, external protection, wooden pallets and any documentation and accessory equipment: manuals, assembly equipment, etc.) to the address indicated by Foodequipment. 

The shipping costs for returning the goods are charged to the customer. 

Only after verifying the integrity of the goods, Forni per Pizza Italiani will proceed to refund the value of the product(s) (within 14 days of return), withholding only the amount of shipping costs, additional services and any cash on delivery costs incurred for the delivery of the goods to the customer and indicated in the accompanying invoice. 

The right is applied to the product purchased in its entirety; it is not possible to receive a refund for only one part of the product. 

The customer is fully liable for the return shipment of the material until receipt in our warehouse. 

In case of damage to the goods during transport, Forni per Pizza Italiani must notify the customer within 5 business days of receipt of the goods, to promptly file a complaint against the courier and obtain a refund of the value of the goods (if insured); in this case, the product will be made available to the customer for its return and the request for withdrawal and refund will be simultaneously cancelled. 

Forni per Pizza Italiani is not liable in any way for damage or theft/loss of goods returned by shipments not insured by the customer. 

The right of withdrawal is totally forfeited due to the lack of the essential condition of integrity of the goods, including the original packaging. 

In the event of forfeiture of the right of withdrawal, the goods will remain available to the customer for collection at his/her expense. 

The right of withdrawal cannot be exercised in the case of supply of tailor-made goods. 

It is the exclusive right of Italian Pizza Ovens to grant exceptions to the aforementioned rules.

To protect against any inconvenience, transport is always insured. 

Shipping costs are automatically calculated at the lowest price once added to the cart. 

  • International shipments 

We entrust our products to the best international couriers who guarantee fast and reliable transport. 

PAYMENTS 

Advance bank transfer 

To speed up order processing times, a copy of the accounting receipt must be sent to shop@fornipavesirimini.it specifying the order number and date.

If you choose the method of payment by credit card, you will be redirected to the payment circuit that will authorise the transaction, protected with 100% secure SSL encryption. 

PayPal 

If you choose the payment method through your PayPal account, your financial information will never be disclosed to third parties. 

Cash on delivery 

Advance payment of 40% with cash on delivery 

You can choose to pay cash on delivery at the time of delivery. 

In this case you will have to advance 40% of the total amount at the time of the order. 

The remaining 60% must be paid cash on delivery directly to the courier, in cash (max. € 1,000) or by cashier’s check. 

Cash on delivery requires an additional cost of 3% on the amount paid upon delivery. The calculation will be made automatically by our systems at the time of the order
